Following his arrest at his home in New York, he was transferred to a remote private prison in Louisiana just hours later, which his supporters claim was a retaliatory measure against his political activities.

Ruling by the Court

On Wednesday, Judge Jesse Furman of the U.S. District Court for the Southern District of New York ruled that Khalil’s case should be heard in New Jersey, rather than Louisiana, as requested by the Trump administration. The judge reaffirmed a previous order that blocks Khalil’s deportation while his legal challenge is processed.

Response from Khalil’s Family and Legal Team

Khalil’s wife, Noor Abdalla, who is currently eight months pregnant, expressed gratitude for the ruling but insisted on continued efforts for justice, stating, “His unlawful and unjust detention cannot stand. We will not stop fighting until he is home with me.”

Legal representatives from the Center for Constitutional Rights underscored the implications of Khalil’s detention. Staff attorney Samah Sisay noted, “The government transferred Mr. Khalil to a remote private prison…an intentional and retaliatory attempt to silence his speech in support of Palestinian rights.”

ACLU senior staff attorney Brett Max Kaufman hailed the ruling as a vital moment that reinforces judicial independence amid perceived executive overreach. He remarked, “The court’s ruling sends a critical message…that the judiciary must not shy from its constitutional role.”

With the case now set to proceed in New Jersey, Khalil’s legal team, led by attorney Amy Greer, pledged to vigorously advocate for his release. Greer stated, “We will not stop working until Mr. Khalil is home with his wife.” The team aims to challenge the legality of his detention and ensure that activists can freely express their viewpoints without fear of persecution.
